While Michael “Max” Nofziger agrees that the current campaign finance limit of $100.00 is restrictive, Nofziger has serious concerns about overturning the will of the people by rushing to the courts.  The campaign finance limits were voted and approved overwhelmingly by the citizens of Austin in 1997.  Katz admitted he did not vote on this issue. Katz had six years to speak out and to take action on campaign limits.

Nofziger is concerned that Katz’s lawsuit will do long term damage to democracy for the sake of gaining short term political advantage.  There is a danger of this lawsuit to voters in that it sends a message that votes do not count.  Nofziger is also concerned about the cost of this lawsuit to the taxpayers.  “This is a time when we need to be strengthening our democracy rather than eroding it.”

In Nofziger’s 1990 and 1993 re-election campaigns to the City Council, he voluntarily imposed a contribution limit of $500.00.  These limits proved workable to contributors and successful to the campaign.
